We have updated our Lottery Terms and Conditions. These new rules are now in effect.

Terms & Conditions

1. Demelza Hospice Care for Children (charity number 1039651) wholly owns a trading subsidiary, Demelza Trading Limited (company number 03090528) which for the purpose of the Gambling Act 2005 promotes a ‘Society Lottery’, the Demelza Lottery.

2. Demelza Trading Limited is licensed and regulated in Great Britain by the Gambling Commission under account number 4802. Responsible persons: Lavinia Jarrett. Registered address Demelza, Rook Lane, Bobbing, Sittingbourne, Kent, ME9 8DZ.

3. Any purchase of lottery entries is from the promoter Demelza Trading Limited. By entering our lottery, you agree to be bound by these terms and conditions, the Gambling Act 2005 and any other regulations that may be established. Any participation instructions will be covered within these terms and conditions.

4. Demelza Trading Limited is a member of the Hospice Lottery Association and the Lotteries Council, who on behalf of their members make a financial contribution towards organisations that are committed to the research, prevention and treatment of gambling harms

5. Demelza reserves the right to update and amend these terms and conditions at any time.

6. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.


7. We operate two draws, the Weekly Lottery and the Superdraw.

8. The Superdraw is an additional draw to the Weekly Lottery and you must have a chance in the Weekly Lottery before you can enter the Superdraw.

9. The draws will be completed each week on a Friday. If the draw cannot be completed on a Friday due to a public holiday or unforeseen circumstances then the draw will be performed on the next available working day.

10. Each draw is conducted using the Tower Systems Lottery Random Number Generator (RNG), which is fully licensed and regulated by the Gambling Commission and has been independently tested, using a variety of industry-standard statistical tests to produce truly random numbers.

11. Each entry in the lottery costs £1 and for the Weekly Lottery entrants will be given a lottery number. For the Superdraw entrants will be given four numbers between a range of 1 to 39.

12. Winners will be announced as soon as practically possible and within three working days on the Demelza website. For the Superdraw, the prize will only be announced when the jackpot prize has been won or the maximum prize amount of £25K. Prizes cannot be claimed by a third party on your behalf.

13. A maximum of three draws may take place retrospectively at the discretion of the Demelza Trading Limited Board of Directors.

14. The maximum number of chances in each draw permitted for any individual is 6. This means you could have a maximum number of twelve chances if you took 6 chances in the Weekly Lottery and 6 chances in the Superdraw.

15. All proceeds, after the deduction of legal prizes and expenses shall be deemed as a donation to Demelza Hospice Care for Children and transferred from Demelza Trading Limited. During the financial year 2023-2024 our lottery generated £1,862,440 with 13% spent on prizes, 26% on expenses and 61% went directly towards the work of Demelza.


16. You must be over the age of 18 to enter the lottery and acknowledge that we reserve the right to carry out age verification checks. Any person found to be under the age of 18 will be disqualified and forfeits any right to a prize.

17. You will not buy or purport to buy an entry to any draw on behalf of anyone under the age of 18 and understand that doing so is an offence.

18. You must be a resident of, and have a bank account in England, Scotland or Wales. Residents from overseas, Northern Ireland, the Channel Islands and the Isle of Man are unable to enter.

19. Entry to the lottery is not permitted to those in management positions within the lottery income stream or those in Senior Leadership Management positions within Demelza.

20. All entrants are solely responsible for providing and where necessary updating Demelza Trading Limited with their accurate and up to date contact details. Demelza Trading Limited will be in no way liable for the failure or inability to contact any member due to errors, omissions or inaccuracies in the contact details that the member has provided.

21. If for any reason a technical interruption, fault or site failure occurs when purchasing lottery entries online, Demelza Trading Limited does not take any responsibility for incomplete purchases. Any incomplete purchases will not be considered valid for entry into a draw. Demelza Trading Limited accepts no responsibility for any purchases which are not complete for any reason.

22. Demelza Trading Limited without giving reason or notice at its absolute discretion may modify, terminate or suspend any of the lotteries in whole or in part.


23. The guaranteed weekly prizes in our Weekly Lottery are: 1x £1,000, 1x £100, 1x £50 and twenty prizes of £10.

24. The odds of winning any prize in the Weekly Lottery are 1 in 1,096 with this estimate taken from number of draw entries on 28/02/2025 and based on 23 available prizes.

25. As a rollover style lottery, the Superdraw does not have a weekly guaranteed prize and the jackpot is created by taking 25% (25p) of every entry to create the jackpot total.

26. The odds of winning a prize in the Superdraw are 1 in 82,251, with this calculation made by assessing the total number of possible combinations available in the Superdraw.

27. The prizes available in our lotteries are printed on promotional materials and are advertised on our website. You cannot request an alternative to any prize and no interest is payable.

28. Demelza reserves the right to withhold payment of a prize if we are not satisfied with the validity or legality of a member, pending further investigation into each case.

29. Demelza Trading Limited will publish or make available information that indicates that a valid prize award took place. To comply with this obligation, we may send the surname and residing county location of major prize winners, and, if applicable copies of their winning entries to anyone who writes to us within one month after the date of the draw. If you object to your surname, county and winning entry being published or made available on request, please contact us. In any circumstances, Demelza Trading Limited must still provide the information and winning entries to the Advertising Standards Agency on their request.

30. After 6 months, should Demelza Trading Limited be unable to pay a prize because we do not hold the correct details, and after thorough investigation which may include communication with the entrants last known bank, we will return the prize to Demelza Trading Limited to be transferred as a donation (with no Gift Aid claimed).

31. Subject to the above clause, prizes will be paid by cheque or BACS transfer within thirty days of the draw date, unless an unforeseen circumstance arises and this may be delayed further. If a cheque is issued but remains uncashed for over 6 months it will be cancelled. Lottery results can be found on the Demelza lottery page.

32. Demelza Trading Limited reserves the right to award any prize to an alternative winner if we have the grounds to believe that entrants have breached any of these terms and conditions, acted fraudulently or illegally or on any other reasonable grounds. Demelza Trading Limited shall have no liability to you for any loss or damage you suffer arising from us exercising such rights.

33. Demelza Trading Limited reserves the right to change or update the prize structure at any time in line with the Gambling Act 2005.


34. Entrants should note the date and frequency of payments and ensure that funds are available to cover Direct Debit payments when they are due. Demelza Trading Limited will not be liable for any charges incurred unless because of our own negligence.

35. Demelza Trading Limited reserves the right to cancel an existing subscription

36. An entrant will be included in the draw for each lottery membership that has had an advance payment received. Any payments made will be held by Demelza Trading Limited and will be credited upon receipt to the relevant number of draws.

37. Entry to the lottery can be made online, by telephone, or by post.

38. Payment to the lottery is to be made by Direct Debit, cheque, or card. We will not accept payment by cash and in the case of remote payments this will not be accepted on credit card.

39. Direct Debits will be collected on the 1st, 15th and 25th of each month, or on the next available working day when falling on a weekend or a bank holiday. Direct Debit frequencies are monthly, quarterly half yearly or annual.

40. Lottery members should note the date and frequency of payments. Demelza will not be liable for any charges incurred by the member, unless because of our negligence.

41. Members will not accrue any debt to the lottery.

42. Any application to join the lottery may be rejected for any reason at the discretion of the promoter.

43. Any lottery entry may be terminated for any reason at the discretion of the promoter

44. The promoter’s decision is final in any matter relating to the lottery.


45. Demelza will not be liable to a member of any loss or damage suffered to a member arising from:

a. Any delays in payments received from members for entry into the lottery

b. Any delays or failure in the postal service or other delivery methods including but not limited to email communication

c. Any failures in the banking system used to process payments to or from Demelza


46. Any complaints relating to the lottery should in the first instance be referred to the Lottery and Gaming Team by email to lottery@demelza.org.uk, by telephone to 01795 845 222 or by post to Demelza, Rook Lane, Bobbing, Sittingbourne, Kent, ME9 8DZ.

We will aim to respond within 3 working days of receipt. In circumstances where a complaint cannot be immediately resolved then it will be referred to the Senior Lottery and Gaming Manager. Should the complaint not be satisfied at this point then it will be escalated to the next leadership level.

If you feel that your complaint is a dispute relating to the operation of the lottery draws and after following our complaints procedure you feel that your dispute has not been resolved then you can raise it with the Independent Betting Adjudication Service (IBAS). IBAS is a gambling specialist Alternative Dispute Resolution Service and adjudicates between gambling operators and their customers.


47. Demelza is registered with the information Commissioner in accordance with the General Data Protection Regulations (GDPR). We are committed to processing all personal information complying with our legal and regulatory obligations and will be clear about what it does with your personal information.

48. Demelza is committed to providing a responsible gambling environment and whilst participation in a society lottery offers the lowest risk of problem gambling, we recognise that some players are unable to enjoy participation in such activity

49. For those entrants that have recognised that their gambling is harmful to them we offer the facility to self-exclude. Self-exclusion can be used by those that wish to be supported to stop gambling and is a commitment to not gamble for a period.

50. The minimum self-exclusion period is six months and a maximum of twelve months can be set initially. This period can be extended by periods of six months and up to five years for online gambling. The self-exclusion will stay in place for seven years (beyond the final period selected), unless the person takes positive action to restart their gambling.

51. Demelza will provide a clear process for supporters to self-exclude and will ensure that we support them in their decision. Entrants can self-exclude by email to lottery@demelza.org.uk, by phone on 01795 845 222 or by post to, Demelza, Rook Lane, Bobbing, Sittingbourne, Kent, ME9 8DZ.

52. A person who has chosen to self-exclude will be contacted to ensure they understand what self-exclusion is and that they are given the details of how to access gambling support.

53. No contact will be made with the individual during the self-exclusion period and Demelza will refuse any request to restart the lottery during this time.

54. During the self-exclusion period Demelza will not send any gambling related marketing materials.

55. The individual’s lottery account will be closed and suspended so that no entries into the lottery are possible.

56. Any balances on the account paid in advance of future draws will be refunded. If the individual paying for their entry by standing order payment, then they will be advised to contact their bank immediately.

57. The individual must make positive action to gamble again, and no contact will be made by Demelza until contact has been made by that individual line with the self-exclusion period.

58. Where an individual chooses not to renew the self-exclusion and makes a positive request to gamble again, then Demelza will give a one-day cooling off period before allowing further participation. This contact must be made by telephone or in person.


59. A copy of this guarantee will be provided to all new memberships. Entrants by Direct Debit will also receive a Direct Debit Advance Notice.

60. The Direct Debit Guarantee is offered by all Banks and Building Societies that accept instructions to pay Direct Debits.

61. If there are any changes to the amount, date or frequency of your Direct Debit then we will notify you normally within 10 working days in advance of your account being debited or as otherwise agreed. If you request us to collect a payment, confirmation of the amount and date will be given to you at the time of the request.

62. If an error is made in the payment of your Direct Debit by us or your Bank or Building Society, you are entitled to a full and immediate refund of the amount paid from your Bank or Building Society. If you receive a refund which you are not entitled to, you must pay it back when you are asked to.

63. You can cancel a Direct Debit at any time by simply contacting your Bank or Building Society. Written confirmation may be required. Please also notify us.
